These General Conditions regulate the purchase of products and services offered on the website www.aulart.com, which is owned by AULART MASTERCLASS S.L. (hereinafter, AULART).

The acquisition of any of the products and services entails the full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Specific Conditions that may be applicable when acquiring certain products and services.

These General Conditions may be modified without prior notice, therefore, it is advisable to read their content carefully before proceeding with the purchase of any of the products offered.

All notifications and communications between users and CLASSJAY shall be considered effective, for all purposes, when they are made by any of the aforementioned means.

3. PRODUCTS AND SERVICES

CLASSJAY offers various digital products and services in its platform and reserves the right to decide, from time to time, what products and/or services are offered to Customers. Thus, CLASSJAY may, at any time, add new products and/or services (or features to them) to those currently offered. CLASSJAY also reserves the right to withdraw or cease to offer, at any time and without notice, any of the products and services offered. In the case of the discontinuation of products or services which are provided on an ongoing basis, Customers of such products and services will be promptly notified about such circumstances.

When purchasing a product or service, the User must follow all the instructions indicated in the purchase process, which will imply the reading and acceptance of all the general and specific conditions set out in https://classjay.com/ .

4. LICENSE

You may be and hereby are granted a license to use our products and services for your personal and/or your internal business purposes only. You may not resell, distribute, or create derivative works from the products or services and you may not develop any service, product, toolset, dataset or derivative work from the products or services either. You may not grant access to third-parties to the products or services unless authorized by us or allowed by the specific terms and conditions of the product or service (or subscription tier, if applicable).

Unless expressly allowed by us (either as part of the product or service features or as included in your subscription tier, if applicable), you agree not to perform any type of automated use of the service, using tools or mechanisms including but not limited to: bots, scrapers, reverse engineering, automated queries, etc.

You acknowledge that your use of our products and services will be in compliance with the applicable laws and regulations.

CLASSJAY will log certain data (as detailed in the Privacy Policy) for the purpose of detecting such misuses. Should you breach any of the above, CLASSJAY may terminate your use of the products and services with immediate effect and without you being entitled to a refund. Furthermore, and especially if the misuse constitutes a breach of laws or regulations, CLASSJAY may undertake appropriate legal action.

5. AVAILABILITY, CANCELLATION AND RENEWAL

CLASSJAY aims to guarantee the availability of all products and services that are offered through www.classjay.com.

For products and services offered on a subscription basis, the Customer agrees to pay promptly each and every subscription fee until cancellation. Failure to pay one of the recurring fees will entitle CLASSJAY to suspend the subscription until the failed payment has been effectively received, in which case the subscription will be reactivated. If no payment is received within 4 weeks (1 month), CLASSJAY reserves the right to consider the subscription as terminated. In such a case, access to the corresponding account will be revoked and all Customer files and data connected with the subscribed product or service will be deleted.

6. PURCHASE AND/OR CONTRACTING PROCESS

Our training products are aimed at users of any age, however, it is necessary that any purchase at https://classjay.com/ is made by a person of legal age.

The steps to follow to make the purchase are:

  1. Select the product or service you wish to purchase and the subscription tier, if applicable.
  2. Fill in your personal details and select the payment method.
  3. Make the payment.

It is also recommended that you keep a copy of the terms and conditions of sale on a durable medium when placing your order, as well as the receipt sent by CLASSJAY by email.

7. INVOICING

If the customer wishes to receive an invoice, he/she should request it by e-mail to info@classjay.com specifying how he/she wishes to receive it.

8. PRICES, COSTS AND TAXES

The prices of the products and services listed on www.classjay.com will be expressed in the currency that CLASSJAY considers, depending on the location of the buyer (euros, dollars, pounds, etc.). Prices are guaranteed for the duration of their validity.

The final prices of all products and services together with their characteristics, offers, discounts, etc., are reflected in each of the articles that appear in the catalog of www.classjay.com.

For intra-community purchases (made in Spain and the rest of the EU), the products and services have the VAT included, applying the corresponding VAT of the country of residence of the purchaser. For purchases outside the EU, VAT or the corresponding tax will not be included and it is the responsibility of the buyer to pay any taxes that may be required at the destination.

The prices of the products and services may vary at any time. In this case, the price to be applied will be that in force on the date the order is placed. In any case, the final cost will be communicated to the customer in the electronic purchase process before he/she formalizes his/her acceptance.

9. PAYMENT METHODS

The following payment methods are available:

  1. By credit or debit card

You can make the payment immediately through the secure payment gateway Stripe. If any refund or cancellation of the order is necessary, the amount will be reimbursed through the same payment card.

  1. PayPal

The payment of the order will be authorized through PayPal, but no money will be withdrawn until PayPal verifies that it is correct. To do this, it is essential to have a PayPal account.

  1. Other payment methods 

Aulart offers other payment methods such as Apple Pay and can introduce other payment methods at any time to facilitate the purchase. In any case, the different methods available will be shown in the purchase process on the website. 

10. RETURNS AND CANCELLATION POLICY

Due to the nature of the services offered by CLASSJAY, once the trial period has concluded, if the user has made a purchase, the user will not have the right to request a refund should he/she decide to withdraw from the contract (see article 103.a and 103.i of RD1/2007, of November 16th, which approves the text referred to in the General Law for the Defense of Consumers and Users).
You may cancel your subscription at any time, effective at the end of the current billing cycle.

12. LIABILITY AND EXEMPTION FROM LIABILITY

The products and services are provided “as is”. Even though CLASSJAY will make its best efforts to provide them with the highest quality standards possible, CLASSJAY cannot guarantee the invulnerability of the systems, so it will not assume any liability for damages resulting from alterations or technical incidents, server downtime (planned or not), network disconnection, others caused by third parties, bugs, cyberattacks, force majeure events, etc. that cause a suspension or interruption of the access to or the malfunctioning of the products and services, to loss or data or similar. This applies as well to such events happening with any of our providers, the products and services of which constitute essential components of our.

12. CUSTOMER SERVICE AND COMPLAINTS

According to the EU Consumer Online Dispute Resolution and in accordance with Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform which is available at the following link: http://ec.europa.eu/consumers/odr/.

13. APPLICABLE LAW

The present conditions shall be governed by the Spanish legislation in force.

The language used shall be Spanish or English.
